RockyPointOwnerDirect reserves the right to modify, update, or discontinue any aspect of the Service at any time without prior notice.
3. No Property Management or Rental Participation
RockyPointOwnerDirect provides software tools and related services but does not act as a property manager, broker, or rental agent.
We do not:
- Manage properties
- Communicate with guests
- Guarantee bookings or revenue
- Participate in rental transactions
All responsibility for bookings, pricing, guest communication, compliance, and operations remains solely with the property owner.
4. Guest Bookings and Transactions
RockyPointOwnerDirect.com may be used by guests to submit booking requests or complete direct reservations with property owners.
RockyPointOwnerDirect is not a party to any rental agreement between guests and property owners.
All bookings are made directly between the guest and the property owner. The property owner is solely responsible for:
- Property condition and accuracy of listing
- Pricing and availability
- Guest communication
- Refunds, cancellations, and policies
- Compliance with applicable laws
RockyPointOwnerDirect does not guarantee the quality, safety, legality, or accuracy of any listing or property.
Any disputes regarding bookings, cancellations, refunds, or property conditions must be resolved directly between the guest and the property owner.
RockyPointOwnerDirect acts solely as a technology platform facilitating connections between guests and property owners.
By using this website to make a booking, guests acknowledge and agree to these Terms.
5. Payments and Tax Responsibility
RockyPointOwnerDirect does not act as a payment processor or merchant of record for rental transactions between guests and property owners.
Payments may be processed through third-party platforms (such as Airbnb, VRBO, Booking.com, Stripe, or other payment providers) or collected directly by the property owner.
RockyPointOwnerDirect does not collect, hold, or remit guest rental payments unless explicitly stated otherwise.
The property owner is solely responsible for:
- Collection of rental payments (when applicable)
- Determining and complying with all applicable tax obligations
- Reporting and remitting any required taxes to local, state, or federal authorities
For bookings processed through third-party platforms (OTAs), those platforms may act as the merchant of record and may be responsible for tax collection and remittance in accordance with their own policies and applicable laws.
RockyPointOwnerDirect makes no representations regarding tax obligations and recommends that property owners consult a qualified tax professional regarding compliance requirements.
RockyPointOwnerDirect shall not be held liable for any tax obligations, reporting requirements, or payment processing issues related to bookings.
6. Account Responsibilities
You are responsible for:
- All activity under your account
- Maintaining accurate information
- Compliance with all applicable laws and regulations
You agree not to:
- Use the Service for unlawful purposes
- Attempt unauthorized access
- Interfere with system functionality
7. Fees, Billing, and Payments
7.1 Subscription Fees
The Service is offered on a recurring subscription basis. Subscriptions are billed monthly, typically on the 1st of each month, unless otherwise specified.
7.2 One-Time Fees
Certain services include one-time charges, including but not limited to:
- Onboarding fees
- OTA setup fees
- Configuration and optimization services
These fees are presented and agreed to prior to billing.
7.3 Billing Structure
RockyPointOwnerDirect utilizes both subscription and usage-based billing.
Subscription Billing (In Advance)
Subscription fees are billed in advance for the upcoming billing period.
Usage-Based Fees (Direct Booking Fees)
Direct booking fees are currently charged at a rate of $10.00 per booking.
These fees are billed separately for the prior month’s activity and are invoiced at RockyPointOwnerDirect’s discretion, typically between the 1st and 10th of the following month.
Acknowledgment
You agree that:
- Subscription fees are billed in advance
- Usage-based fees are billed in arrears
- Invoices may be issued separately
- RockyPointOwnerDirect’s records are deemed accurate unless disputed within 15 days
Billing Disputes
Any billing disputes must be submitted in writing within 15 days of the invoice date. Failure to do so constitutes acceptance of the charges.
7.4 Payment Authorization
By providing a payment method, you authorize RockyPointOwnerDirect to charge all applicable fees.
7.5 Non-Refundable Fees
All fees are non-refundable once:
- The Service has been provisioned, or
- Work has commenced
7.6 Failed Payments
Failure to pay may result in suspension or termination of access to the Service.
8. Cancellation and Termination
You may cancel your subscription at any time.
- Cancellation takes effect at the end of the current billing period
- No refunds will be provided for unused time
RockyPointOwnerDirect may suspend or terminate services for:
- Non-payment
- Violation of these Terms
9. Third-Party Services
The Service may integrate with third-party platforms including:
- Airbnb
- VRBO
- Booking.com
- Stripe
- PriceLabs
RockyPointOwnerDirect does not control, guarantee, or warrant these services and is not responsible for their performance or policies.
Changes, outages, API limitations, or policy updates by third-party platforms may impact functionality, and RockyPointOwnerDirect shall not be held responsible for such impacts.
RockyPointOwnerDirect does not guarantee compatibility with all third-party platforms or future platform changes.
10. No Guarantee of Results
RockyPointOwnerDirect makes no guarantees regarding:
- Booking volume
- Revenue
- Occupancy rates
Results vary based on numerous factors outside our control.
11. Data and Information
You retain ownership of all data you provide.
RockyPointOwnerDirect is not responsible for:
- Data loss
- Data accuracy
- Backup or storage failures
12. Intellectual Property
All Service-related content, software, and materials are the property of RockyPointOwnerDirect.
You are granted a limited, non-transferable license to use the Service for your business.
13. Disclaimer of Warranties
The Service is provided “as is” without warranties of any kind, express or implied.
14. Limitation of Liability
RockyPointOwnerDirect shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of revenue, bookings, or data
Total liability shall not exceed the total amount paid by you to RockyPointOwnerDirect in the previous 12 months.
15. Indemnification
You agree to indemnify and hold harmless RockyPointOwnerDirect from any claims, damages, or liabilities arising from:
- Your rental activity
- Your use of the Service
16. Modifications
These Terms may be updated at any time. Continued use of the Service constitutes acceptance of any changes.
